How Does UAE Labour Law Calculate Gratuity?

UAE Labour Law Article 51 calculates gratuity on the last basic salary, excluding all allowances. The standard rate is 21 days per year for the first 5 years, then 30 days per year after.

Standard Gratuity Formula

The same rate applies whether you resign or face termination, for all service from February 2, 2022.

UAE Labour Law Formula:

  • Years 1-5: Service Years × 21 days × Basic Salary ÷ 30

Old Unlimited Contract Resignation (Pre-Feb 2022)

What Salary Does UAE Labour Law Use for Gratuity?

UAE Labour Law Article 51 uses the last basic salary only for gratuity. Basic salary excludes housing, transport, and all other allowances.

Your employment contract lists basic salary as a separate figure from your total package. The total package adds allowances and benefits, but the gratuity calculation uses the basic figure alone.

Variable components do not count. Performance bonuses, commission, overtime, flight allowances, and education allowances all sit outside basic salary, which is why entering your full package overstates the result.

When Does UAE Labour Law Require Gratuity Payment?

UAE Labour Law Article 53 requires gratuity payment within 14 days of the last working day. The deadline runs from your final day, including any notice period served.

What is Maximum Gratuity Under UAE Labour Law?

How Does UAE Labour Law Handle Partial Service Years?

UAE Labour Law Article 51(3) grants pro-rata gratuity for partial years after the first full year. The calculation converts months into a decimal.

Three years and six months counts as 3.5 years. Six months equals 0.5 years, and nine months equals 0.75 years. The calculation includes all service after the first qualifying year.

What Changes Did UAE Labour Law Introduce in 2022?

UAE Labour Law ended new unlimited contracts and removed the resignation gratuity penalty effective February 2, 2022. All new contracts are fixed-term.

The biggest change for workers: resignation no longer reduces gratuity. A worker who resigns after one year now receives the same full rate as a worker who is terminated, for all service from February 2022.

Job title changes, department transfers, and internal promotions do not break continuity. Service accumulates across all contract periods with the same employer.

Notice periods and paid leave count as service. Article 51(2) excludes only unpaid absence from the service count.

Can Gratuity Be Reduced or Withheld Under UAE Labour Law?
